Mumbai, Maharashtra – January 11, 2016 – A Special Judge for Greater Mumbai, Shri S.V. Ranpise (Court Room No. 17), today granted conditional bail to Anjum Nurulhasan Newrekar, a 45-year-old Assistant Engineer with the Building and Factory Department of ‘E’ ward BMC, Byculla. Newrekar was arrested in a corruption case just three days prior.

Newrekar had filed Bail Application No. 02 of 2016 in connection with ACB, GMU Mumbai C.R. No. 01/2016. He was arrested on January 8, 2016, for offenses punishable under Sections 7, 13(1)(d) read with 13(2) of The Prevention of Corruption Act, 1988.

According to the prosecution, represented by Ld. APP Mr. Lade, Newrekar was apprehended while demanding a bribe of Rs. 5,00,000/- (Rupees Five Lakhs only) and accepting a partial amount of Rs. 2,00,000/- (Rupees Two Lakhs only). The State opposed the bail application, citing that the investigation was still at a preliminary stage and a bank locker belonging to the accused was yet to be seized.

Ld. Advocate Mr. Karde, appearing for Newrekar, argued that his client’s custodial interrogation was complete and he was now in judicial custody. He asserted Newrekar’s innocence, stating that the allegations were false, and emphasized that his client is a permanent resident of Mumbai, a BMC employee, has no criminal antecedents, and his family is dependent on him. Mr. Karde assured the court that Newrekar was ready to cooperate with the investigating machinery for further probe.

After hearing both sides, Judge Ranpise noted that the custodial interrogation was indeed over, and the bribe amount had already been recovered. The court also acknowledged that a house search of the accused had been carried out. Addressing the prosecution’s concern regarding the unseized bank locker, Mr. Karde explicitly submitted that the applicant was willing to cooperate with the investigation regarding its seizure and would not open it without court directions.

Considering Newrekar’s status as a permanent resident of Mumbai and his employment with the Bombay Municipal Corporation, the court deemed it proper to grant bail with certain conditions.

Conditional Bail Granted:

Anjum Nurulhasan Newrekar has been ordered to be enlarged on bail upon executing a Personal Recognizance (P.R.) Bond of Rs. 30,000/- (Rupees Thirty Thousand only) with one or more solvent sureties in the like amount.

In a separate order, the court also permitted Newrekar to submit a provisional cash security of Rs. 30,000/- for a period of four weeks.

The bail is subject to the following stringent conditions:

• The applicant shall not leave Mumbai without prior permission of the Court.
• He shall not pressurize witnesses or tamper with the evidence.
• He must attend the concerned A.C.B. Office every Wednesday between 10:00 a.m. to 5:30 p.m. until the charge-sheet is filed.

The decision allows the Assistant Engineer to be released from custody while the Anti-Corruption Bureau continues its investigation into the bribery allegations.
