Mumbai, Maharashtra – December 10, 2015 – A Special Judge for Greater Mumbai, Shri S.V. Ranpise (Court Room No. 17), today granted conditional bail to Anil Dadu Mhaisale, a 53-year-old Police Havildar, who was arrested in connection with an alleged bribery case involving Rs. 900.

Mhaisale, residing at Dadar Railway Police Quarters, had filed a bail application (Bail Application No. 74 of 2015) in C.R. No. 19 of 2015, registered with the Anti-Corruption Bureau (ACB), Mumbai.

According to the State, represented by Ld. APP Mr. Lade, Mhaisale was arrested due to the illegal demand and acceptance of Rs. 900. The prosecution had opposed the bail, stating that the investigation was still at a preliminary stage.

However, Ld. Advocate Mr. Parab, appearing for Mhaisale, argued that his client, a head police constable, was falsely implicated and that his custodial interrogation was already complete. He emphasized that Mhaisale, being 53 years of age and a permanent resident of Mumbai with a dependent family, was willing to abide by any conditions imposed by the court.

After hearing both sides, Judge Ranpise observed that the custodial interrogation was indeed over and Mhaisale was already in judicial custody. Considering the accused’s age, his long service with the Mumbai police, and his permanent residence, the court found it appropriate to grant bail. The judge also took into account the “nature of allegations” (implicitly the relatively small bribe amount) and the fact that the “entire investigation” would take time.

Conditional Release:

The court allowed the application, ordering Anil Dadu Mhaisale to be enlarged on bail upon executing a Personal Recognizance (P.R.) Bond of Rs. 15,000/- (Rupees Fifteen Thousand only) with one solvent surety in the like amount.

In a separate order, the court also allowed Mhaisale to submit a provisional cash security of Rs. 15,000/- for a period of four weeks.

The bail has been granted subject to the following conditions:

• Mhaisale must attend the concerned A.C.B. Office every Wednesday and Friday between 11:00 a.m. to 12:00 noon.
• He shall not leave Mumbai without prior permission of the Court until the charge-sheet is filed.
• He shall not pressurize witnesses or tamper with the evidence.

The order was pronounced on December 10, 2015, facilitating the release of the police havildar while the investigation into the corruption case proceeds.
