Mumbai, August 24, 2018 – In a ruling from the Special Court for Greater Bombay under the Narcotic Drugs and Psychotropic Substances (NDPS) Act, Additional Sessions Judge Shri S.V. Yarlagadda has granted bail to Anish Dayashankar Rajbhar, accused in a case involving ganja possession.

Rajbhar, 25, was arrested on August 10, 2018, in Crime No. 34/2018, facing charges under Sections 8(c), 20, and 29 of the NDPS Act for allegedly possessing 1 kilogram and 200 grams of ganja.

During the proceedings, Ms. Suvidha Patil represented the applicant, while Mr. P.S. Tawade, the Additional Public Prosecutor, appeared for the State and opposed the bail.

The court noted that the quantity of ganja seized falls into the “intermediary quantity” category—more than a small quantity but less than a commercial quantity. This distinction is crucial as it means the stringent bail conditions of Section 37 of the NDPS Act, usually applicable for commercial quantities, were not attracted in this case.

While the prosecution argued that Rajbhar was a habitual drug dealer and might re-offend, the court decided to grant bail with strict conditions.

Anish Dayashankar Rajbhar will be released on a Personal Recognizance (P.R.) Bond of Rs. 25,000/-, with one or two solvent sureties of the same amount. The bail comes with two key conditions:

• He must not commit any offense similar to the one he is accused of.
• He must not directly or indirectly threaten, induce, or promise anyone connected to the case to prevent them from disclosing facts or tampering with evidence.

The application was allowed and disposed of accordingly. The order was dictated and pronounced in open court on August 24, 2018, and uploaded on September 10, 2018.
