Mumbai – A Mumbai Sessions Court, on April 13, 2022, denied bail to Shoaib Moharamali Mirza Baig, who is accused of attempting to murder a police officer by assaulting him with a knife, all while allegedly violating an externment order that barred him from entering Mumbai.
Baig, 30, was arrested in connection with Crime No. 90/2022 registered at Shivaji Nagar Police Station. He faces serious charges under Sections 307 (attempt to murder), 353 (assault to deter a public servant from duty), and 333 (voluntarily causing grievous hurt to deter a public servant from duty) of the Indian Penal Code. Additionally, he has been charged under Sections 142, 37(1)(A), and 135 of the Maharashtra Police Act, which pertain to unlawful assembly and contravention of prohibitory orders, likely referring to his alleged violation of the externment.
Accused Found in Mumbai Despite Externment
During the bail application hearing, Baig’s advocate, Mr. Parikshit (appearing for Mr. Amit Munde), argued that his client was innocent, that a false case had been registered against him, and that the ingredients of Section 307 IPC (attempt to murder) did not apply. He also stated that Baig was ready to abide by any conditions imposed by the court if granted bail.
However, the Assistant Public Prosecutor (APP), Mr. Ramesh Siroya, strongly opposed the application, emphasizing the serious nature of the offense and stating that the investigation was still in progress. He expressed concerns that Baig might abscond if released on bail.
Court Highlights Seriousness of Allegations
Additional Sessions Judge G.B. Gurao, after perusing the First Information Report (FIR) and the prosecution’s submissions, highlighted several critical points that led to the denial of bail. The court noted that Baig was an individual who had been externed from Mumbai, yet was found within the city limits, indicating a violation of a legal order.
The complainant in the case, Police Naik Dilip Sargar, is a serving officer attached to the Anti-Gunda Squad. The court observed that while Police Naik Sargar was performing his duty and taking action against Baig, the accused allegedly “assaulted him by knife and he sustained injuries.”
In his order, Judge Gurao concluded: “It appears that accused being externed from Mumbai, entered into Mumbai and prevented complainant, a public servant while discharging his duty and intentionally assaulted him by knife. The offence is serious. Investigation is in progress. Hence, considering the nature of offence, I find that the accused is not entitled for bail.”
The court, therefore, rejected Bail Application No. 624 of 2022, deeming the alleged crime too grave to warrant release at this stage of the investigation.
