This is an application for bail under Section 439 of Cr. P.C.
Heard Ld. Advocate for the applicants and Ld. APP for the State.

The Ld. Advocate for applicants submitted that applicants
are arrested by Tilak Nagar police station in connection with Crime
No.31/2024 for the offence punishable under Sections 353, 323, 504,
506, 186 of IPC. It is further contention of applicant that he is falsely
implicated by police in this case. Applicant has not committed any
offence as alleged. In view of allegations no custodial interrogation is
necessary. Therefore, he prayed for grant of bail.

Ld. APP and IO opposed the application. It is contention if
he is released on bail there is possibility of tempering of evidence of
prosecution. Therefore, he prayed for rejection of application.

In view of submissions from both sides and on perusal of
the first information report, when informant was performing his duty
of surveillance in the area at that time applicant found in suspicious
condition under influence of liquor or inquiry incident occurred. In view
of allegations there is no need of further custodial interrogation.
Therefore, in such circumstance further detention of applicant is not
required. Hence, by imposing condition applicant may be released on
bail. Therefore, I pass following order :ORDER
1.

Criminal Bail Application No.278 of 2024 is allowed.

2.

Applicant/accused Sagar Suresh Thombe be released on bail on
furnishing P.R. Bond of Rs.25,000/- along with one or more
sureties in the like amount in connection with C.R. No.31/24
registered with Tilak Nagar police station.

3.

Applicant/accused shall attend Tilak Nagar Police Station,

Mumbai, as and when required by Investigating Officer on notice.
4.

Applicant/accused shall furnish his residential address proof and
contact numbers to Investigating Officer.

5.

Applicant/accused shall not directly or indirectly, make any
inducement, threat or promise to any person acquainted with the
facts of the case so as to dissuade him from disclosing such facts
to the Court or to any Police Officer.

6.

Applicant/accused shall not leave India without previous
permission of the Court.

7.

Bail before learned Court below.

8.

Criminal Bail Application No.278 of 2024 stands disposed of
accordingly.
