Heard Ld. Adv. for the applicant / accused no. 2, Ld. APP.

The Advocate for accused no. 2 contended that the accused no. 2 is
falsely implicated in the offence and they are presently residing at
Mumbai and the accused no. 2 is Police Naik, Mahim Police Station and
there is no possibility of the accused running away from the justice.

The Ld. APP submitted that there is likelihood of the
accused no. 2 tampering with the witness and further investigation in
the offence is remaining and hence B.A. no. 211/18 be rejected.

The court has rejected the PCR demand of the I.O. and has
sent the accused no. 2 to MCR. The voice sample of the accused no. 2
has been obtained. The further investigation can be carried out if the

accused no. 2 directed to remain present before the I.O. Further the I. O
can also investigate with the accused no. 2 during such presence. For
that reasons only bail can not be denied. In this condition the accused
no. 2 can be enlarged on Bail by putting conditions.
Accordingly, I proceed to pass order on following terms:
ORDER
In the circumstances B.A. is allowed. Accused no. 2 Ramesh Sabaji Teli
be released on executing P.B. and S. B. of Rs. 15,000 with one surety in
the like amount and with condition that the accused no. 2 not to tamper
prosecution witness in any manner neither leave India without prior
permission of this court. The accused no. 2 to remain present before the
I.O. for further investigation on every Saturday from 10.00 a.m. to 1.00
p.m. till the charge sheet is filed. At this stage the Ld. Adv. for accused
no. 2 submitted that provisional cash bail be granted. In the
circumstances the accused no. 2 be released on Executing P.B. of
Rs.15,000/­ and furnishing cash bail of Rs. 15,000/­ for period of 4
weeks. The Registrar to accept the amount of cash bail of Rs. 15,000/­
each A.T.H. Bail Application no. 211/18 disposed off.
