Application for bail
ORAL ORDER
1.

Present application is filed by the applicant u/s. 439 of
The Code of Criminal Procedure, 1973 for bail in CR No.03 of 2016
registered with ACB, Mumbai
for the offences punishable u/s.

7,13(1)(d) r/w 13(2) of The Prevention of Corruption Act 1988 in
which present applicant was arrested and after investigation he is
now in judicial custody and therefore he has filed this application
on following grounds:н
GROUNDS
That applicant has not committed any offence as
alleged, he is residing at Kalyan, false
allegations are levelled against him,
he is ready and willing to abide by any conditions
imposed by the Court, he has no criminal
antecedents, his family depends upon him etc.,.

State has filed say and raised objection on the ground
that accused was apprehended while accepting bribe amount of
Rs.2,000/н and the investigation is at preliminary stage.

Point No.1

From the submissions, it is gathered that custodial
interrogation is over. Moreover, applicant is working as P.S.I. and
he is residing at Kalyan, Thane. He has shown his ready and
willingness to abide by any conditions imposed by this Court. No
doubt State has raised objection on the ground that an amount of
Rs.2,000/н is recovered from the custody of the accused at the time
of raid, but , accused has challenged it on the ground that he is
falsely involved in the said crime. Considering the same and when
applicant has to look after his family and considering his age, I hold
it proper to allow this application by imposing certain conditions.
Hence, I answer point No.1 in the affirmative and proceed to
pass the following order:н
ORDER
1.

Application is allowed.

2.

Applicant be enlarged on Bail on executing
P.R.Bond of Rs.15,000/н(Rs.Fifteen thousand
only) with one or more solvent surety/sureties in
the like amount, subject to the
conditions that Applicant should not leave
Mumbai/Thane District without prior permission
of this Court, should not pressurize the
witnesses, tamper with the evidence and should
attend concerned A.C.B. Office on every Tuesday
and Friday in between
11.00 am to 2.00 pm
till filing of the chargeнsheet.
