ORAL ORDER
1.

The applicant/accused, junior clerk working in Family
Court, Bandra, found accepting the bribe amount of Rs.1000/н from the
complainant for issuing the certified copies of the judgment and order.
Concerned investigating officer on due verification laid the trap. During
the police custody the voice sample of the accused came to be recorded.
It appears that the substantial part of the investigation has been
completed.

The application is strongly opposed by the Ld. A.P.P. on the
ground that the accused may hamper or tamper the prosecution
witnesses.
3.

The interest of the prosecution, however, can be protected
by imposing some conditions upon the applicant/accused.

The
applicant/accused is the resident of Mumbai and as appears is a
government servant.

The possibility of fleeing from justice is not
possible. In the interest of justice, application for bail stands allowed in
following terms :
ORDER
1.

Bail Application No.449/17 stands allowed.

2.

Applicant / accused be released on executing P.R. bond of
Rs.15,000/н and surety in the like amount.

3.

He is directed to report to Investigating Officer, Anti Corruption
Bureau, on every Monday and Thursday in the morning in
between 10 a.m. to 11 a.m. till filing of the chargesheet.

4.

He shall not tamper the prosecution witnesses in any manner.

5.

He shall not leave India without prior permission of this Court.
