Present application is filed by the applicant under Section 439
of Cr.P.C. for bail in connection with C.R. No. 76 of 2014 filed in R.A. No.
68 of 2014 registered with ACB, Mumbai Division for the offences
punishable under Sections 7, 8, 13(1)(d) and 13(2) of the Prevention of
Corruption Act, 1988.

The applicant has filed this application on the ground that he
is in jail since long. He has not committed any offence, as alleged. He is

ready and willing to abide by any conditions imposed by the Court. He is
young and his family depends upon him for their earning etc,.

The State has objected this application on the ground that if
this application is allowed, the applicant is likely to abscond and likely to
pressurize the witnesses and tampering with the evidence and it would
cause effect on the witnesses.

REASONS
I have heard learned advocate Mr. Salunkhe for applicant and
Learned APP Mr. J.V. Desai for State.
I have gone through the documents placed on record.
Point No.1 :н
From the submission as well as documents it is gathered that
the applicant is ready and willing to abide by any conditions imposed by
this Court. Moreover, his family depends upon him. The custodial
interrogation seems to be over. The applicant has shown his ready and
willingness to abide by the conditions imposed by this Court. Considering
the same and assurance given by the advocate to proceed with the trial as
early as possible in case the chargeнsheet is filed, I hold it proper to allow
the application, subject to certain conditions. Hence, I answer point no. 1

in the Affirmative and proceed to pass the following order.
ORDER
1. Bail Application No. 88 of 2014 in C.R. No. 76 of 2014 in
R.A. No. 68 of 2014 is allowed.
2. The applicant Maheshchandra Sarjerao Naykude be
enlarged on bail on executing PR Bond of Rs. 20,000/н
(Rupees Twenty Thousand Only) with solvent surety of like
amount subject to the conditions as follows that :
a) Applicant should attend concerned ACB office on first
day of each month in between 9 a.m. to 10 a.m. till further
orders.
b) Applicant should not pressurize the witnesses and tamper
with the evidence and should not leave India without prior
permission of this Court and if he is holding any passport then
he should submit it into the Court.
3. Bail Application stands disposed off accordingly.
