ORDER
This is an application filed by the accused u/sec.439 of
Criminal Procedure Code for releasing him on bail in connection with
C.R.No.17/2024 registered with South Cyber Police Station, Mumbai for

the commission of offences punishable u/sec.419, 420, 465, 468, 471,
120B of the Indian Penal Code and Section 66 (c), 66 (d)of Information
Technology Act.

It is the contention of the applicant / accused that he is
innocent and falsely implicated in the present case. The accused is
arrested on 30.03.2024. He has undergone custodial interrogation.
Nothing is to be seized or recovered from the possession of the accused.
Therefore, there is no point in keeping accused behind bars. He is a
permanent resident of his given address therefore he prayed for
releasing him on bail.

The prosecution opposed the application by filing reply
vide Exh.2. If the accused is released on bail it will affect on the
collection of evidence. The investigation is not completed therefore if
the accused is released on bail there are chances of flee from justice. If
the accused is released on bail there are chances of threatening of
prosecution witnesses and tampering prosecution evidence. Hence,
prosecution prayed for rejection of the application.

the ld. Advocate for the applicant and ld. APP for the State.

I have gone through the application, reply, documents filed
on record. It is the case of the prosecution that informant Anil Makhija
lodged report that the unknown accused created forged link of
bookmyshow and obtained online ticket bookings of IPL 2024 cricket
matches and thereby cheated the informant’s company and general
public.

It is revealed that the accused applicant has facilitated the
commission of offence. His bank accounts was involved in the offence,
in which the amount of online booking tickets has been deposited.
There is evidence of CC TV footage. The investigation is at primary
stage. The accused has played vital role in commission of this offence.
Detail investigation is necessary. Release of accused on bail will hamper
the investigation. Hence the accused is not entitled for the bail. In the
result I passed the following order:
ORDER
Criminal Bail Application No.970 of 2024 is rejected
and disposed off accordingly.
