Order on appliction received from the jail by an E­mail

The accused who is facing trial for the charge of
commission of offences punishable under Section 395, 397 of
the I.P. code and Sections … of the MCOC Act. The accused has
moved this application for interim bail on the strength of
direction/guidelines (for short, the said directions) issued by the
Hon’ble High Power Committee in the meetings dated
25.03.2020 and 14.05.2020. The said directions are issued in
furtherance of the judgment and order passed in Suo Moto W.P.
(C) No. 1 of 2020, by the Hon’ble Supreme Court. They are
convened to this Court through Maharashtra State Legal
Services Authority.

Perused the application for interim bail. The learned
S.P.P. is absent when called.

I have carefully gone through the directions given by
the Hon’ble High Power Committee. Upon perusal of the same,
it is found that the Special Acts like MCOCA and NIA have been
specifically excluded from consideration. However, the Hon’ble
High Court has given directions to decide such applications on
merit. Upon perusal of the application, it is found that the said
application has been mainly filed on the basis of the directions
given by the High Power Committee. Thus, no case is made out
for grant of interim bail. In view of this, the application fails,
and accordingly it deserves to be rejected. Resultantly, the
following order is passed,
ORDER
Applicaiton stands rejected.
