ORDER

This is an application U/s.439 of Code of Criminal
Procedure(hereinafter referred to as “Cr.P.C.) for the grant of bail to
the applicant Chand Abdul Shaikh in C.R.No.3 of 2022 of Vashi

Railway Police Station, Mumbai for the offence punishable U/s.379
of Indian Penal Code.

As per case of the prosecution, informant is Savita
Madhukar Ghalke. On 3/1/2022, someone committed theft of her
mobile from the local train between Ghansoli towards Panvel.
Applicant was arrested and mobile is recovered from him. Applicant
is having three criminal antecedents of similar nature. However,
investigation is over and chargesheet is filed. Considering the
nature of offence, punishment prescribed for the offence and this is
application for grant of bail, I am inclined to allow the application.
Hence, I pass following order.
ORDER
1
Bail Application No.633 of 2022 is hereby allowed.

Applicant Chand Abdul Shaikh in C.R.No.3 of 2022 of
Vashi Railway Police Station, Mumbai for the offence punishable
U/s.379 of Indian Penal Code be released on bail on executing PR
bond of Rs.15,000/- with one surety of the same amount.

Applicant to furnish his detailed address, phone number
at the time of furnishing bail.

Bail before the Court attending remand.

Applicant to attend Vashi Railway Police Station,
Mumbai as and when called by the investigating officer.

Applicant shall not, directly or indirectly, make any
inducement, threat or promise to any person acquainted with the
facts of the accusation against himself so as to dissuade him from
disclosing such facts to the Court or to any police officer.

Applicant shall not leave India without previous
permission of the Court.

Bail Application is disposed off accordingly.
