ORDER
This is an application for bail filed by the accused Buddhajan
Bhiva Jadhav in Crime No.45 of 2015 for the offence punishable under
section 7 of the Prevention of Corruption Act.

Heard the the advocate for the accused and learned A.P.P. for
the State and the investigating officer.

It is contended by the accused that he has been falsely
implicated in the matter and he is nothing to do with the alleged offence.
It is pointed out by the advocate for the accused that the investigation is
almost completed. He has deep root in the society. The applicant is also
ready to coнoperate with the investigating agency. It is also argued by the
learned advocate for the accused that he is even to ready to coнoperate in
search of the bank locker if so required during the investigation.

The learned A.P.P.. has filed reply and opposed the application
on the ground that the accused may tamper with the prosecution evidence
and may pressurize the witnesses, as the investigation is still in progress
and the bank locker is yet to be searched .

Today, the accused has been taken in the judicial custody.

The voice sample of the accused had been taken. The house search is also
completed. As far as further investigation is concerned, the presence of
accused can be secured for this purposes by putting certain conditions. As
far as the search of the locker is concerned, as the accused has shown
willingness to coнoperate in the investigation, this purpose can be served
by giving suitable directions to the accused in this regard. I do not find
any fruitful purpose will serve by keeping the accused in judicial custody.
In this circumstances, I find it proper to release the accused on bail on
following conditions. Hence, the order:н

ORDER
The Bail Application No.44 of 2015 is hereby allowed.

The applicant/accused Buddhajan Bhiva Jadhav be released
on bail, on furnishing P.R. bond of Rs.25,000/н (Rupees twenty five
thousand only) with one or two solvent sureties in the like amount on
following conditions:

The accused shall attend the ACB Office on every Monday and
Thursday between 10 a.m. to 12 noon till filing of the chargeнsheet.

The accused shall not tamper the prosecution witnesses and
evidence in any manner whatsoever.

The accused is directed to submit bank locker details before
the ACB on 17.08.2015 at 10.00 a.m.

The accused shall not operate the bank locker without prior
intimation to the ACB and shall coнoperate the ACB in respect of search of
the bank locker during investigation.

The ACB do the needful to inform the concerned bank
accordingly.

Six weeks time is granted to accused to furnish solvent surety
and in the meantime, he is directed to deposit cash of Rs.25,000/н today.

The office to accept the cash after office hours.

Bail Application No.44 of 2015 stands disposed of accordingly.
