ORDER
1.

Perused the application and say filed by the Investigating Officer.

2.

Heard the learned Advocate for the accused, learned PP and the
Investigating Officer.
3.

The custodial interrogation of the accused is not necessary for
further investigation. Hence, the accused is taken in judicial custody.
The accused is permanent resident of Powai. The learned PP submits
that, if the accused is released on bail and if he is directed to give his
attendance before the Investigating Officer, it will serve the purpose.

Considering the submissions of the learned Advocate for the
accused, the learned PP and the Investigating Officer, I hold that the
application is deserves to be allowed because, the accused is permanent
resident of Powai and he is Government servant.

It is not the
contention of the Investigating Officer or the learned PP that there is
likelihood of absconding the accused, if he is released on bail. However,
considering the fact that, the investigation is in progress it would be just
and necessary to direct the accused to give his attendance before the
Investigating Officer.

In the result, I proceed to pass the following
order.
Order
1.

Bail Application No.41 of 2016 is allowed.

2.

Accused be released on furnishing PR. Bond of Rs.15,000/н (Rs.

Fifteen Thousand only) with surety in the like amount.
3.

The
accused
shall
not
tamper
with
the
prosecution
witness/evidence.
4.

The accused shall attend before the Investigating Officer in the
office of A.C.B., Mumbai, on every Monday and Thursday in between
11.00 am. to 1.00 pm. till further order.
5.

Cash surety of Rs.15,000/н be accepted after treasury hours.

6.

One month time is granted for furnishing surety.

7.

Bail Application No.41 of 2016 stands disposed of.
