Applicant/accused who is arrested in Crime No.428/2022 for
the offence punishable under Sections 354, 509, 504 and 323 of Indian
Penal Code has filed this application for bail under Section 439 of The Code
of Criminal Procedure.

I have heard Advocate Jignesh K. Jain for applicant and APP
R.V. Tiwari for the prosecution. APP submitted to pass appropriate order.

As per the record, applicant/accused is behind bar in execution
of NBW since 18.01.2024. He is charge-sheeted for bailable offences under
Sec.354, 509, 323 of IPC. It seems that applicant/accused did not remain
present for the trial and likely to give threat to informant, hence his bail
application is rejected by learned Metropolitan Magistrate, 11 th Court,
Kurla, Mumbai. Considering nature of allegations and the record annexed
with bail application, applicant/accused can be enlarged on bail with
conditions. Hence, I pass following order :ORDER
1.

Bail Application No.947 of 2024 is allowed.

No.428/2022 of Chembur police station be released on bail by executing
PR bond of Rs. 15,000/- with one surety of like amount on following
conditions i.

Applicant/accused shall attend first day of every month at
Chembur police station to ensure his attendance in Court during
trial. He shall attend each and every date of the case.
ii.

Applicant/accused shall not contact in any manner and not to
pressurize or give threats to informant or any prosecution witnesses.
iii.

Applicant/accused shall not enter in the limits of Tilak Nagar
where the informant is residing till recording evidence of the
informant.

Applicant/accused shall not commit any offence while on bail
and breach of any of aforesaid conditions will be ground to cancel bail.

On oral request of Advocate, accused is permitted to furnish cash
security of Rs.15,000/- in lieu of surety provisionally for three weeks.

Bail in Trial Court.

Bail Application No.947 of 2024 stands disposed off accordingly.
