The applicant/accused Krishna Ashok Waydande
claims bail in C.R. No. I88/2022 for the offences punishable
under Sections 376, 376(2)(n), 504 & 506 of the Indian Penal
Code registered with Bhadrakali Police Station.

Heard Learned Advocate Shri A.J.Bhide, for the
applicant and learned A.P.P. Shri Nikam for the State. Perused
the papers of investigation.

It is the case of the prosecution that applicant and
informant got acquainted with each other through social media
since 2019.
They engaged in loveaffair. But then, informant’s
family arranged her marriage with some other boy and it was

performed.

Thereafter, it is the contention of informant that
applicant started blackmailing her and also sexually exploited
her.

On perusal of record, it reveals that informant is 23
years old major and matured lady.
She has admitted that she
was in relationship/loveaffair with applicant. She has further
admitted that she has performed marriage as per the wish of her
family.
She has mentioned that last incident occurred on
18.12.2021 but then, report came to be lodged on 04.04.2022. It
is the contention of informant that on 28.12.2021, she has
disclosed the incident to her husband but then also there is delay
in lodging report.

Being major and matured lady, the informant was
well aware about the consequences of physical intimacy with the
person other than husband. Case of the informant prima facie
found to be in cloud. Howsoever it may be, record reflects that,
applicant came to be arrested on 22.04.2022. Now, there is no
recovery or discovery as such remains from the applicant.
According to ld. Advocate for the applicant, applicant has no
criminal antecedents.
He is a permanent resident of Mumbai
and is ready to abide any conditions on grant of bail.
Considering all these aspects, this Court is of the view that
applicant can be released on bail by imposing certain conditions.
Hence the order.

of trial.
c] Applicant is directed to furnish his
permanent address proof, mobile number.

Application is hereby allowed.
2/
In the event of arrest of the applicant – Amol
Avinash Chavan in C.R. No. 16/2022 of Wani Police
Station, be released on
PR and SB of Rs.20,000/
with one or two solvent sureties in the like amount
subject to following conditions.
a)
Not to act in manner injurious to the interest of
the prosecution.
b)
maintain law and order.
c)
furnish the address of his residence, copy of Pan
or the Adhar card at the time of execution of bond
and shall not change the residence without prior
permission of this Court.
d)
He shall attend the concerned police station as
and when called by the Investigating Officer and
cooperate with the investigation.
