A Bengaluru City Civil and Sessions Court has refused to grant bail to M. Gopi, the second accused in a harrowing kidnap-for-ransom case that unfolded in the early days of 2023. The court ruled that the gravity of the charges, which include abduction for ransom and assault with a deadly weapon, outweighs the petitioner’s claims of innocence and familial responsibility.

The order was delivered by Sri R. Ravi, the LXI Additional City Civil and Sessions Judge, on February 2, 2023. The petitioner, 26-year-old M. Gopi, a resident of ITI Layout, Hosapalya, had sought release under Section 439 of the Code of Criminal Procedure after being held in judicial custody following his arrest by the Bandepalya Police.

The Allegations: A Debt Dispute Turned Violent

The criminal case, registered as Crime Number 05/2023, stems from a terrifying incident on the night of January 9, 2023. According to the prosecution, the complainant was at a local hotel for dinner around 8:30 p.m. when he was approached by two acquaintances, Shabeer and Ajnan. The duo demanded the balance payment for a vehicle purchase. When the complainant requested the vehicle’s documents before clearing the dues, a heated argument ensued.

The situation escalated rapidly when Shabeer allegedly summoned a group of associates, including the petitioner M. Gopi, along with Adil, Khutu, and Teju. The group is accused of forcibly kidnapping the complainant and transporting him to a room in Mangamanapalya.

Once confined, the accused allegedly brandished a knife and assaulted the complainant, causing bleeding injuries. The victim was then moved to a hotel in BTM Layout. From there, the kidnappers contacted the victim’s mother, abusing her over the phone and demanding a ransom of Rs. 35,000 for his safe release. The mother, acting out of fear for her son’s life, paid the demanded sum to the group.

Arguments for the Defense

Represented by Sri M.V. Murthy, the petitioner argued that he was merely a driver by profession and had no involvement in the alleged criminal acts. The defense contended that Gopi was a friend of the complainant and was being falsely implicated simply because of a separate financial dispute where he owed money to the complainant.

The defense further argued that Gopi is the sole breadwinner of his family, responsible for supporting aged parents. Highlighting his status as a permanent resident of Bengaluru with no prior criminal record, the advocate claimed there was no risk of the petitioner fleeing justice. Gopi expressed his willingness to abide by any court-imposed conditions to secure his release.

Prosecution Opposes Release

The Public Prosecutor strongly opposed the bail application, citing the report from the Investigating Officer. The prosecution argued that the materials collected during the investigation prima facie establish the petitioner’s active participation in a “heinous” crime. They raised concerns that if released, the petitioner would likely abscond or use his freedom to intimidate witnesses and the complainant, thereby derailing the trial.

The Court’s Ruling

In his analysis, Judge R. Ravi observed that the charges filed against Gopi are of a very serious nature. Specifically, Section 364(A) of the Indian Penal Code (Kidnapping for Ransom) is a capital offense, carrying a maximum penalty of death or life imprisonment.

The judge noted that the prosecution’s evidence suggests a coordinated effort to extract money through violence and abduction on a public road. The court referenced established legal precedents, noting that when dealing with heinous offenses, the judiciary must prioritize the severity of the punishment and the reasonable grounds of involvement over personal hardships.

“The materials placed on record prima facie show the involvement of the petitioner in the commission of the alleged heinous offense of kidnapping the complainant for ransom,” the court noted.

Finding that the petitioner failed to provide sufficient grounds to overcome the severity of the allegations, the court dismissed the bail application. M. Gopi will remain in judicial custody as the legal proceedings against the group continue.
