This is an application under Section 439 of Cr.P.C. for
releasing accused Royal Edward Sequeira on bail in Crime No.145/2010
for the offences punishable under Sections 420, 170 r/w 34 of the
Indian Penal Code registered with V. P. Road Police Station, Mumbai.

Heard learned Counsel for accused and learned APP for the
State. Perused Bail Application, say/reply and other documents filed by
applicant.

It is case of prosecution that accused has by personating
himself as Police Officer dishonestly induced complainant to deliver
amount of Rs.6 lakh and thereby cheated the complainant. Prosecution
has filed charge-sheet against accused for the above offence.

Learned Counsel for applicant/accused argued that accused
was released on bail in the above crime in the year 2010. He has
attended Court on every date till the year 2016. Later on he was
arrested in another Crime bearing FIR No.17/2016, registered with
Koyana Nagar Police Station Tal. Patan, District Satara. Therefore, he
was not able to attend this case. Accused could not inform to the Court
about his arrest in the crime No.17/2016. Accused was in jail from
16.04.2016 to 24.04.2024 for a period of 8 years. After releasing from
the jail, he has filed application for cancellation of NBW before learned
trial court on 07.05.2024. However, learned trial court has rejected the
said application and send the accused in jail.

It is matter of record that accused was released on bail in
this case. Accused has filed copy of release certificate issued by jail
authority. It shows that accused was in Yervada Jail and released on
24.04.2024 after undergoing the imprisonment. Thus, there is
substance in contention of accused that due to above reason, he could
not attend this case. Thus, in view of above facts and nature of the
offense, I am of the opinion that by imposing reasonable conditions,
accused can be released on bail. Thus, in view of above facts, it is
desirable to release accused on bail. Hence, I pass following Order.
ORDER
1. Criminal Bail Application No.1250 of 2024 is allowed.

2. Accused Royal Edward Sequeira be released on bail in Crime
No.145/2010 for the offences punishable under Sections 420,
170 r/w 34 of the Indian Penal Code registered with V. P. Road
Police Station, Mumbai, subject to conditions :
i) Accused shall execute a Personal Bond for the sum of
Rs.20,000/- with one or more sureties in the like amount.
ii) Accused shall not tamper with any of the prosecution
witnesses, directly or indirectly.
iii) Accused shall inform his latest place of residence and mobile
number immediately after being released and/or change of
residence or mobile details, if any from time to time to the
concerned Court.
iv) Accused shall appear before the Court regularly on the given
dates.
vi) Bail be furnished before learned trial court.
