Mumbai, Maharashtra – November 17, 2017 – A Special Judge constituted under the Prevention of Corruption Act for Greater Mumbai, Shri A. S. Bhagwat (Court Room No. 45), today granted conditional bail to Amol Annaso Patil, an employee of the Municipal Corporation of Greater Mumbai (MCGM), who is an accused in a corruption case being investigated by the Anti Corruption Bureau (ACB).

Patil was granted bail in Bail Application No. 684/17, related to ACB Mumbai’s C.R. No. 41/17.

During the proceedings, Amol Patil’s legal counsel, Mr. Jagdish Shetty, contended that his client was falsely implicated in the offense. He emphasized that Patil is a permanent resident of Mumbai and an employee of the MCGM, asserting there was no possibility of him evading justice.

The Special Public Prosecutor (APP) Mr. J.V. Desai, representing the State, opposed the bail application. He argued that there was a likelihood of the accused tampering with witnesses and that the investigation regarding the complicity of other persons in the offense was still ongoing.

After considering the arguments, Judge Bhagwat noted that the court had previously rejected the Police Custody Remand (PCR) demand of the Investigating Officer (I.O.) and had sent the accused to Magisterial Custody Remand (MCR). The court also noted that the voice sample of the accused had already been obtained.

The Judge observed that further investigation, including inquiries into the involvement of other individuals, could proceed even without the accused remaining in custody. “For that reasons only bail can not be denied,” the court stated, concluding that bail could be granted with appropriate conditions.

Bail Conditions Imposed:

Amol Annaso Patil has been ordered to be released on executing a Personal Bond (P.B.) and Surety Bond (S.B.) of Rs. 15,000/- (Rupees Fifteen Thousand only) with one surety in the like amount.

The bail is subject to the following conditions:

• The accused shall not tamper with prosecution witnesses in any manner.
• The accused shall not leave India without the prior permission of the court.
• The accused shall remain present before the Investigating Officer every Saturday from 10:00 a.m. to 1:00 p.m. for further investigation, including obtaining of his voice sample, until the charge sheet is filed.

The bail application has been disposed of accordingly, allowing Patil to be released from custody while the ACB continues its probe.
