Heard Ld. Adv. for the applicant / accused, Ld. APP. The
Advocate for accused contended that the accused is falsely implicated in
the offence since he wanted to adopt due procedure of law as per the
ruling of Hon’ble Supreme Court in regard to the arrest of the accused
in the complaint filed by complainant. Whereas the complainant wanted
the accused there in to be immediately arrested. So the complainant has
falsely implicated the accused.

The Ld. APP submitted that there is likelihood of the
accused tampering with the witness and hence B.A. be rejected.
3.

The investigation so far as it requires the physical custody
of the accused is over. His voices samples has been obtained. Hence the
physical custody of the accused is not required for further investigation.

In this condition the accused can be enlarged on Bail by putting
conditions.
Accordingly, I proceed to pass order on following terms:
ORDER
In the circumstances B.A. is allowed. Accused Jalindar Babaso Misal be
released on executing P.B. and S. B. of Rs. 15,000 each with one surety
in the like amount and with condition to remain present before the I.O.
on every Tuesday between 10.00 a.m. to 11.00 a.m. till filing charge
sheet. The accused not to tamper prosecution witness in any manner
neither leave India without prior permission of this court. B.A. 580/17
disposed off.
