Heard Ld. Adv. for the applicant / accused, Ld. APP. The
Advocate for accused contended that the accused are falsely implicated
in the offence and they are permanent resident of Mumbai and
employee in M.C.G.M. and there is no possibility of the accused running
away from the justice.

The Ld. APP submitted that there is likelihood of the
accused tampering with the witness and investigation regarding
complicity of other persons in the offence is remaining and hence B.A.
be rejected.
3.

The court has rejected the PCR demand of the I.O. and has
sent the accused to MCR. The voice sample of the accused has been

obtained. Further the I. O can also investigate with the accused during
such presence about complicity of any other person involved in the
offence. For that reasons only bail can not be denied. In this condition
the accused can be enlarged on Bail by putting conditions.
Accordingly, I proceed to pass order on following terms:
ORDER
In the circumstances B.A. is allowed. Accused be released on executing
P.B. and S. B. of Rs. 15,000 with one surety in the like amount and with
condition that the accused not to tamper prosecution witness in any
manner neither leave India without prior permission of this court. The
accused to remain present before the I.O. for further investigation
including obtaining of voice sample on every Saturday from 10.00 a.m.
to 1.00 p.m. till the charge sheet is filed. B.A. disposed off.
