On April 11, 2022, the Court of Additional Sessions Judge Shri B.V. Wagh (C.R. No.24) in Mumbai rejected the bail application of Sameer Mehboob Ansari, a 20-year-old accused in a murder case registered under Section 302 read with Section 34 of the Indian Penal Code. The bail plea was filed in connection with C.R. No. 395/2021 lodged at Wadala T.T. Police Station.
According to the prosecution, on the early morning of November 23, 2021, informant Sanjay Kale, who was on night duty with Mobile Van No.1, received an alert from the Control Room about an unconscious person near the Wadala Monorail Depot. Upon reaching the location, Kale found an injured man lying in a pool of blood beside an auto-rickshaw. The victim was immediately taken to a hospital but was declared brought dead on arrival.
During the subsequent investigation, surveillance footage and other evidence revealed the movements of the accused at the scene. According to the prosecution, this led to the identification and arrest of the individuals involved, including the applicant, Sameer Ansari. The post-mortem report confirmed 13 stab injuries on the deceased’s vital parts and listed the cause of death as hemorrhagic shock due to multiple stab wounds.
While the defense argued that there was no direct evidence implicating Ansari and that the weapon used was recovered from co-accused Shahbaz, the court noted significant circumstantial evidence. This included the testimony of a witness who saw the accused fleeing the scene and the recovery of blood-stained clothes from Ansari. The court emphasized that the nature of the incident and the number of injuries pointed toward the accused’s direct involvement. It held that how the quarrel escalated and resulted in the fatal attack was within the exclusive knowledge of the accused, and thus, the case presented serious and credible evidence of his complicity.
Given the gravity of the offense and the prima facie material on record, the court rejected the bail application, observing that releasing the accused at this stage could hinder the investigation or influence witnesses. Consequently, Criminal Bail Application No. 686 of 2022 was dismissed.
