Mumbai: Ramesh Udayraj Yadav, 48, accused in an alleged attempted murder case, has been granted bail by the Sessions Court for Greater Bombay. The order, issued by Additional Judge Shri G.B. Gurao (C.R.17) on April 20, 2022, allows Yadav’s release on a personal recognizance (PR) bond of Rs. 20,000/- with one or more sureties of the like amount. He has also been granted provisional cash bail of Rs. 20,000/- for four weeks.
Yadav, a resident of Mankhurd, Mumbai, was arrested in connection with Trombay Police Station’s C.R. No. 67/2022, facing charges under Sections 307 (attempt to murder), 323 (voluntarily causing hurt) read with 34 (acts done by several persons in furtherance of common intention) of the Indian Penal Code (IPC), and Sections 37(1)(A) and 135 of the Maharashtra Police Act.
His advocate, Mr. Imran Shaikh, argued that Yadav was innocent and had not committed any crime. He submitted that the major part of the investigation had been completed and that custodial interrogation was no longer necessary. Yadav undertook to abide by any conditions imposed by the court.
Mr. Ramesh Siroya, the learned Additional Public Prosecutor (APP) for the State, opposed the bail application, contending that the investigation was still in progress and that Yadav, if released, might pressurize the complainant and prosecution witnesses.
A crucial development during the hearing was the intervention of the complainant. The complainant personally appeared before the court and stated that he had given the initial complaint “under misunderstanding.”
After reviewing the First Information Report (FIR) and the prosecution’s ‘say’ (reply), the court noted the allegations that Yadav assaulted the complainant with a knife on the right shoulder, right chest, and back, leading to the complainant’s admission to Sion Hospital. However, the court also observed that the alleged weapon had been seized, and there was “no recovery or discovery at the instance of accused” pending.
Considering the completed major part of the investigation, the specific facts and circumstances of the case, and significantly, the complainant’s statement that the complaint was made “under misunderstanding,” Additional Judge Gurao concluded that Yadav was entitled to bail.
Accordingly, Criminal Bail Application No. 653 of 2022 was allowed. Ramesh Udayraj Yadav is to be released on bail subject to the following conditions:
- He shall attend the concerned police station as and when reasonably required by the investigating officer till further orders.
- He shall not pressurize the prosecution witnesses in any manner.
- He shall not commit any offense while on bail.
- He shall attend the dates of Court regularly unless exempted by the Court.
- He shall furnish his correct address to the investigating officer.
The court also specified that the bail procedure should be conducted before the learned Magistrate. The bail application was disposed of accordingly. The order was dictated and transcribed on April 21, 2022, and signed on April 27, 2022. It was uploaded on April 25, 2022.
