Mumbai, April 30, 2022 – A Mumbai Sessions Court today granted bail to Chand Abdul Shaikh, 27, who was arrested in connection with the theft of a mobile phone from a local train. Additional Sessions Judge R.M. Sadrani allowed the bail application (B.A. No. 633 of 2022) filed under Section 439 of the Code of Criminal Procedure, despite the applicant having a history of similar offenses.

Shaikh was accused in C.R. No. 3 of 2022 registered at Vashi Railway Police Station for an offense punishable under Section 379 of the Indian Penal Code (theft).

Case Background

According to the prosecution, the informant, Savita Madhukar Ghalke, reported on January 3, 2022, that her mobile phone was stolen from a local train traveling between Ghansoli and Panvel. During the investigation, Chand Abdul Shaikh was arrested, and the stolen mobile phone was recovered from him.

The prosecution informed the court that the applicant has three prior criminal antecedents of a similar nature. However, it was also noted that the investigation in the current case is complete and the chargesheet has already been filed.

Court’s Decision

After considering the nature of the offense, the prescribed punishment, and the fact that the investigation was concluded, Additional Sessions Judge R.M. Sadrani decided to grant bail. The judge stated, “Considering the nature of offence, punishment prescribed for the offence and this is application for grant of bail, I am inclined to allow the application.”

Bail Conditions

Chand Abdul Shaikh has been ordered to be released on bail upon executing a Personal Recognizance (PR) bond of ₹15,000/- (Rupees Fifteen Thousand Only) with one surety of the same amount.

The bail order includes several conditions that the applicant must adhere to:

• He must furnish his detailed address and phone number when providing bail.
• He must attend Vashi Railway Police Station as and when called by the investigating officer.
• He is prohibited from directly or indirectly making any inducement, threat, or promise to any person acquainted with the facts of the accusation to dissuade them from disclosing facts to the Court or police.
• He shall not leave India without prior permission from the Court.

The bail application has been disposed of accordingly.
