This is an Bail Application filed by
Applicant/Accused under section 439 of Cr.P.C.

The
applicant/accused has been arrested in C.R.No. 33 of 2022
by L.T. Marg Police Station, Mumbai.

The contention of the applicant/accused that, crime No.33
of 2022 registered against him for the commission of offence punishable
under section 381 of IPC. It is further alleged by the applicant/accused
that, he was arrested on 13.02.2022. The investigation officer filed
chargesheet in the court, so entire investigation was completed. The
applicant/accused is falsely Implicated in the present crime. Applicant/
Accused was in service in the office of informant since last 10 years.
Applicant has permanent resident of Mumbai, therefore there is no
possibility of tempering prosecution case.

Hence, applicant prayed for
grant bail.

The prosecution opposed the application on ground that
from all Muddemal only 175.68 gold was recovered from the accused
and 604.85 grams gold yet to be recovered. If accused release on bail it
will be affecte on called to
discharge evidence against him, so
prosocution prayed for rejection of bail application.

Presued application, say filed by the prosecution. Heard
both the advocates at length.

The accused prosecuted for the
commission of offence punishable under section 381 of IPC. It is come
to on record that accused was arrested prior to four months back. The
investigation officer carried the investigation and filed chargesheet in
the Court. So stolen property was seize from the possession of the
accused.

Therefore, in my opinion once the chargesheet is filed,
therefore custodial interrogation of the accused is not necessary. The
property already seized from the possession of accused. Therefore there
is no point to keep him in behind the bar,

Bail Application No. 680 of 2022 is allowed.

Accused Shridhar Laxman Gije arrested in C.R.No. 33 of 2022 L.T.
Marg Police Station for the commission of offence punishable
under section 381 of IPC be released on P.B. and S.B. of Rs.
50,000/- with one or two surety/s.

The accused shall not tamper with the prosecution witnesses and
evidence in any manner.

Provisional cash bail in the like amount is allowed. The accused
shall furnish surety within 4 weeks from the date of release
from jail failing which the cash bail shall stand forfeited without
any separate order to that effect.

Bail before the learned committing Court.

Bail Application No.680 of 2022 is disposed off accordingly.
