Present application is filed by the applicant for grant of bail
in Crime No.75/2022 registered with Tardeo Police Station, for the
offence punishable under Section 353, 279, 336, 504 of IPC and under

sections 184 and 177 of Motor Vehicles Act.

On 15.03.2022, at about 3.50 am, informant was on duty
at Haji Ali Junction, near Dabewala statue, Tardeo, Mumbai. It is
alleged that applicant driving his Motor Cycle in a high speed came
from the direction of Mahalaxmi temple towards Haji Ali junction. The
informant gave signal to stop the vehicle to the applicant. The applicant
applied break while taking turn due to which his Motor Cycle slipped on
the road. The informant took the applicant and his Motor Cycle by the
side of the road. The informant inquired applicant reason for driving
vehicle through wrong side on that applicant abused him in filthy
language. Accordingly, crime is registered against the applicant.

The Learned advocate for applicant submitted that
applicant is falsely implicated in crime. There are no allegations that
applicant had used any criminal force and restrained informant from
performing his duty. The applicant is arrested on 15.03.2022. Since
then he is behind bar. He is ready to abide conditions imposed and
prayed for grant of bail.

Per contra, vide Say (Exh.2), Ld. APP opposed the
application. It is submitted that presence of the applicant at the spot is
not disputed. The applicant abused informant in filthy language. The
investigation is in progress. Hence, prayed for rejection of the
application.

Perusal of FIR, the allegations against applicant are that he
drived his Motor Cycle in high speed and abused applicant. Applicant is
of young age. He is arrested on 15.03.2022 and since then he is behind

bar. Except offence u/s 353 of IPC rest are triable by the Magistrate
Court. No criminal antecedents are pointed against the applicant.
Considering the matter, there would not be prejudice to the prosecution
if suitable conditions are imposed while granting bail to the applicant.
Hence, I proceed to pass following order:­
ORDER
1.

Bail Application No.658 of 2022 is allowed.

2.

The applicant/accused Sagar Parshuram Mangle be released
on bail in C.R. No.75/2022 registered at Tardeo Police
Station, on furnishing P. R. bond of Rs. 15,000/­ (Rupees
Fifteen Thousand Only) with surety of like amount.

3.

Applicant shall not commit any other or similar offence.

4.

He shall furnish the photo copy of his Aadhar Card, photo
copies of documents of his permanent and temporary
residential address, to the Court.

5.

He shall give intimation in writing to I.O. as and whenever he
changes his residential/temporary address.

6.

Provisional cash bail allowed for 6 weeks from today.

7.

Bail to be furnished before Learned Metropolitan Magistrate
Court. Learned Metropolitan Magistrate shall accept the cash
bail as above.

8.

Bail Application No.658/2022 stands disposed off.
