This application has been filed by the applicant/accused
under section 438 of Cr.P.C. for releasing him on anticipatory bail
in the event of his arrest in the aforesaid Crime registered at Satpur
Police Station, for the offence punishable under section 354, 324, 325
of the Indian Penal Code and accordingly interim protection was
granted to applicant.

IO is present. Perused the papers.

It is the case of the prosecution that the applicant has
outraged the modesty of informant, abused her and threatened her
and also assaulted her husband.

On perusal of record, it reveals that the informant is major
lady 32 years old. There are case and cross­case filed by both the
parties against each other. It is pertinent to note that the alleged
incident occurred on 10.06.2022 at about 10.00 pm.

The applicant’s mother­in­law
has lodged NC against the informant party on the very same day of
the incident. The applicant has also produced copy of NC which was
filed by the informant on the day of alleged occurrence which does not
reflect any allegation of outraging modesty. All these aspects prima
facie create doubt about veracity of report. False implication cannot
be ruled out. On these amongst grounds, interim bail was granted to
the applicant on 11.08.2022.

Now, say is filed by the IO and
submitted that the charge­sheet is filed. It appears that the applicant
cooperated the investigation.

As per the contention of ld. Advocate, the applicant has no
criminal antecedents. He is a local resident and is ready to abide any
conditions imposed upon him. Therefore, considering all these aspects,
this Court is of the view to confirm the interim protection granted to
applicant. Hence, the order.
