Heard Ld. Adv. for the applicant / accused Ld. APP. The
Advocate for accused contended that the accused are falsely implicated
in the offence and they are presently residing at Nalasopara, District
Palghar and the accused is sr. clerk in the office of Ghankachara
Vyavasthapak office and there is no possibility of the accused running
away from the justice.

The Ld. APP submitted that there is likelihood of the
accused tampering with the witness and further investigation in the
offence is remaining and hence B.A. be rejected.

The court has rejected the PCR demand of the I.O. and has
sent the accused to MCR. The voice sample of the accused has been

obtained. The further investigation can be carried out if the accused
directed to remain present before the I.O. for certain period. Further the
I. O can also investigate with the accused during such presence. For that
reasons only bail can not be denied. In this condition the accused can be
enlarged on Bail by putting conditions.
Accordingly, I proceed to pass order on following terms:
ORDER
In the circumstances B.A. is allowed. Accused Prashant Narsinha Kini be
released on executing P.B. and S. B. of Rs. 15,000 each with one surety
in the like amount and with condition that the accused not to tamper
prosecution witness in any manner neither leave India without prior
permission of this court. The accused to remain present before the I.O.
for further investigation on every Monday from 10.00 a.m. to 1.00 p.m.
till the charge sheet is filed. At this stage the Ld. Adv. for accused
submitted that provisional cash bail be granted. In the circumstances
the accused be released on Executing P.B. of Rs.15,000/ each and
furnishing cash bail of Rs. 15,000/ each for period of 4 weeks. The
Registrar to accept the amount of cash bail of Rs. 15,000/ each A.T.H.
Bail Application no. 214/18 is disposed off.
