ORAL ORDER
1. Applicant/accused is seeking regular bail under section
2
439(1) of Code of Criminal Procedure.
2. Perused the application and say. Heard both sides.
3. Applicant/accused was arrested by the police under
execution of warrant charged under Sections 186, 332,
353, 143, 145, 146, 147, 149 r.w. 504 of the Indian Penal
Code r.w. Section 85(1) of Liquor Prevention r.w. Section
33 with 132 of Maharashtra Police Act vide CR No.28 of
2016 of Chembur police station.
4. It is submitted by the applicant/accused that he went to his
native place due to sad demise of his father-in-law and
stayed at native for a period of more than one year and
therefore did not remain present before the Ld. Addl.
C.M.M. for trial. Therefore, the Court issued NBW against
the applicant/accused. The applicant/accused filed fresh
bail application before the Ld. Addl. Chief M.M. 11 th Court,
Kurla which came to be rejected on 28/02/2024. Therefore,
the present bail application is filed before this Court.
5. The applicant/accused is in judicial custody since the date
of arrest i.e. 30/01/2024.

Earlier the applicant/accused
was released on bail on PR bond of Rs.10,000/-.
By
making
these
submissions,
Ld.

Advocate
for
applicant/accused prayed to release him on bail.
6. Ld. A.P.P. submitted that the applicant/accused was aware
of the Court proceedings. But, he did not remain present
before the Court and therefore NBW was issued against
him.

7. Considered the submissions advanced on behalf of both
sides. Earlier the applicant/accused was released on bail by
the Ld. Addl. Chief M.M. on furnishing PR bond of
Rs.10,000/-.

The applicant/accused is in custody since
30/01/2024.

The chargesheet is filed in the year 2016
itself.
8. Considering the nature of the offence, I am of the opinion
that this is a fit case in which discretion can be exercised in
favour of applicant/accused. Hence, I incline to release him
on bail. In the result, following order:ORDER
1.

Cri.Bail application No.593 of 2024 is allowed.

2.

The applicant/accused- Karan Pandari Waghmare
S/O Pandharee Waghmare, be released on furnishing PB of
Rs. 10,000/- with one surety of the like amount in CR
No.28 of 2016 registered at Chembur police station.
3.

The applicant/accused shall not directly or indirectly
make any inducement, threat or promise to any person
acquainted with the facts of the case so as to dissuade him
from disclosing such facts to the Court or to any Police
Officer or tamper with the evidence.
4.

The accused/applicant shall not commit similar
offence while on bail.
5.

The accused/applicant shall not leave India without
prior permission of the Court.

The accused/applicant be released on provisional
cash bail of Rs.10,000/- for a period of four weeks from
today.
7.

Bail Application No.593 of 2024 is disposed of
accordingly.
